Av. Magistrate Besnik Muçi
Besnik Muçi is practising lawyer, former Judge of the Constitutional Court of the Republic of Albania and former Prosecutor with 25 years of experience. Mr. Muçi graduated from the Faculty of Law, University of Tirana in 1995 and obtained his Master of Science Degree in Criminal Law in 2011 with excellent results. In 1999-2001, Besnik Muçi attended the School of Magistrates where he earned the title of “Magistrate Prosecutor” with excellent results.
Mr. Muçi worked as Officer of the Judicial Police for one year, 1996-1997, and as of September 1998 Mr. Muçi was member of the Chamber of Lawyers Korça, working as a lawyer in Pogradec until September 1999. As of 2001, he held the function of Prosecutor for six years at the Prosecution Office of the District of Tirana. In 2007-2008, he was the Director of the Directorate against Economic-Financial Crime in the General Directorate of State Police. For the next twelve years, 2008-2019, Mr. Muçi held the function of Prosecutor at the Serious Crimes Prosecution Office. During this period, Mr. Muçi has conducted complex investigations in the organised crime domain, using methods of infiltration and controlled delivery. These methods remain unique in their use by the Albanian Prosecution Office to this day. For three years, he was Deputy Head of the Serious Crimes Prosecution Office (2017-2019). During 2013, Mr. Muçi was Head of the Prosecution Office of the District of Kavaja.
Mr. Muçi has contributed to the drafting of the Antimafia Law (Law no. 10 192, dated 3.12.2009 “For the Prevention and Strike of Organised Crime, Trafficking, Corruption, and Other Crimes through Preventive Measures against Property”) and was one of the first Prosecutors of the Republic to have submitted and defended requests based on the new procedure provided for by this law before the Court.
He is member of the Albanian Bar Association since 1998 and Professor in Albanian public and private universities in Criminal Law, Criminal Procedure, International Courts, History of Institutions, Legislative Technique, Criminalistics, Criminal Ethics, etc. In 2002, Mr. Muçi published a book titled “Criminal offenses in the field of narcotics”, where he made a historical and juridical analysis of the criminal offenses in the field of narcotics in Albania since the Criminal Code of King Zog I up to the current legislation. He also made a comparative analysis with jurisdictions such as the United States, the United Kingdom, France, Italy and Greece.
Since 2002, Mr. Muçi has lectured and participated in numerous international and national trainings organised by the Government of the United States, OSCE, the EU, etc. Additionally, he has continuously published dozens of scientific and mediatic articles.
For ten years, 2008-2018 Mr. Muçi was engaged as Expert at the School of Magistrates for training the Judges and Prosecutors of the Republic of Albania. Among the topics of training were the implementation of the Antimafia Law (civil confiscation) and special techniques for investigating organised crime.
Additionally, he has been active in representing the Republic of Albania in international organisations such as the MONEYVAL Committee of the Council of Europe (2007-2008, representative of the Minister of Interior) and as expert (2014-2019) and member of the Bureau (2015-2017) of the Conference of the Parties on the Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism, also known as the Warsaw Convention or CETS 198. Mr. Muçi had the responsibilities of overseeing the implementation of the Convention in the State Parties and draft recommendations. In 15.10.2019-21.11.2019, Besnik Muçi was Judge of the Constitutional Court of Albania.
In July 2020, Mr. Muçi founded MuçiLaw which he manages successfully to this day. His expertise focuses on criminal law, including in particular civil confiscation, and administrative law, human rights and arbitration. He has and is currently representing big market players, such as media companies in highly-sensitive and complex litigation. Moreover, several companies have entrusted him for legal consulting.
Mr. Muçi is known for great attention to detail and for tailoring the solution to the client with a view to achieve the best result.
